General conditions governing access to this website and the contractual framework for web design and development services provided by Warspect.

1. Service provider identification

This website warspect.com (hereinafter, 'the Site') is operated by Warspect, an independent professional digital studio providing web engineering, UI/UX design, and customized digital solutions, located in Lima, Republic of Peru. By accessing, browsing, or utilizing this Site, you become a user and express full and unconditional agreement with these Terms and Conditions ('T&C'). If you do not agree with any clause set forth herein, you must refrain from using this Site or submitting requests through its forms.

2. Scope of services

Warspect delivers premium engineering and interface design services designed to elevate brand authority and digital conversions. Our core service portfolio includes:

  • Landing pages: Conversion-focused, high-performance web pages engineered for product launches, marketing campaigns, and lead capture with precise messaging.
  • Corporate websites: Authoritative digital presence for enterprises requiring structured presentation of capabilities, credentials, and brand values.
  • E-commerce: Scalable product catalogs and shopping experiences built with modular architectures and integrated payment gateways.
  • Showcase websites: Elegant product and service portfolios offering curated discovery without the operational complexity of a full transactional store.
  • UI/UX design: Information architecture, high-fidelity wireframes, interactive prototypes, and scalable design systems centered around user clarity.

The Site serves as an informational platform and initial contact venue. Definitive technical and commercial specifications for any engagement are established via customized formal proposals agreed upon with each client.

3. Engagement and contracting workflow

Service contracting follows an orderly step-by-step workflow ensuring full transparency and operational certainty:

3.1 Engagement stages

  • Inquiry reception: The client submits an inquiry through the Site form or official direct channels.
  • Formal proposal: Warspect prepares and delivers a formal commercial proposal detailing scope of work, technical requirements, timeline, deliverables, and total fee.
  • 50% upfront payment upon visual demo: Following presentation and approval of the initial visual demo/concept, the client remits the 50% upfront payment to trigger full technical development.
  • Engineering & delivery: Warspect develops, tests, and optimizes the web application in accordance with approved benchmarks.
  • Remaining 50% payment: Upon project completion and functional validation, the client settles the remaining 50% balance, triggering final handover and administration access.

3.2 Electronic contract validity

Pursuant to Peruvian Law N° 27291 on the use of electronic means for expression of will and celebration of legal acts, the contract is deemed legally binding from the moment the client explicitly approves the formal proposal (via email, WhatsApp, or verifiable digital messaging) and performs the initial upfront payment.

4. Pricing and payment terms

Fees are quoted on a custom project-specific basis, reflecting the scope, technical complexity, interactive modules, and integration requirements of each brief.

4.1 Accepted payment channels

  • Bank transfers in Peruvian institutions: BCP, Interbank, BBVA, and Scotiabank.
  • Peruvian digital wallets: Yape and Plin.
  • International settlements: PayPal for international clients or clients selecting this option.
Payment security

Warspect will never request credit card numbers or banking credentials through this website. Account numbers and billing invoices are issued exclusively via verified @warspect.com email addresses.

4.2 Transaction currency

Proposals are denominated in Peruvian Soles (PEN) or United States Dollars (USD) as agreed upon. For international clients outside Peru, USD is the binding contractual benchmark currency.

5. Cancellation and refund policy

Under Peruvian Law N° 29571 (Consumer Protection and Defense Code) and applicable consumer regulations, Warspect establishes the following cancellation terms:

5.1 Cancellation prior to development kickoff

If the client unilaterally cancels after approving the proposal but prior to code engineering, the 50% retainer is non-refundable, as it covers initial discovery, requirements structuring, visual demo design, and allocated operational capacity.

24-hour grace window

If written cancellation is notified within 24 continuous hours of payment and before further technical work has commenced, Warspect will evaluate issuing a full refund in good faith.

5.2 Cancellation during development

Should the client cancel after technical engineering has commenced, the 50% upfront payment is retained in full as fair compensation for work rendered. Warspect will release all work artifacts, wireframes, and design components produced up to the effective cancellation date.

5.3 Cancellation due to Warspect fault

If Warspect is unable to deliver due exclusively to causes attributable to its own party, a proportional refund corresponding to the unexecuted phases will be promptly remitted to the client.

5.4 Scope of revisions

Each agreement specifies a predefined number of revision rounds. Structural changes departing substantially from approved wireframes or requests exceeding agreed deliverables will be quoted as separate supplemental scope.

6. Deliverables, warranties, and maintenance

Technical excellence and post-launch reliability underpin our commitments:

6.1 Delivery timeline

Delivery schedules are customized according to project architecture and documented in the accepted proposal. Client delays in furnishing required brand assets, texts, third-party credentials, or formal milestone approvals automatically extend the delivery schedule proportionally.

6.2 15-business-day bug warranty

Upon final project delivery, Warspect provides a fifteen (15) business-day functional warranty to resolve any functional defect, responsive rendering anomaly, or bug at no additional charge, provided the defect is not caused by unauthorized tampering by the client or third parties.

6.3 1-month complimentary operational support

Clients receive one (1) calendar month of complimentary basic support following handover, covering operational guidance and minor stability adjustments. Subsequent feature requests, evolutionary updates, or ongoing maintenance require a dedicated retainer agreement.

6.4 Hosting and domain infrastructure

Warspect advises on optimal domain registrars and cloud hosting providers. However, domain ownership, server contracts, and recurring vendor payments remain the direct responsibility of the client. Warspect assumes no liability for hosting downtime, DNS provider incidents, or third-party server outages.

7. Intellectual property and work ownership

Rights governing deliverables and technical assets are structured as follows:

7.1 Admin dashboard autonomy

Upon launch, the client is granted full administrator access to their website dashboard or CMS, empowering them to manage editorial content, products, and commercial information without interacting with source code.

7.2 Source code ownership

Proprietary source code, base libraries, performance utilities, and custom software architectures developed by Warspect remain Warspect's intellectual property. Standard deliverables confer an irrevocable, non-exclusive license to operate the website. Full assignment of underlying source code rights or white-label code repository transfers constitutes an optional standalone service subject to independent pricing and agreement.

7.3 Client-owned brand materials

The client retains absolute ownership of all trademarks, brand logos, imagery, and text provided for development. The client represents that they possess all necessary licenses and holds Warspect harmless against any third-party copyright or trademark infringement claims.

7.4 Portfolio showcase

Warspect reserves the right to exhibit the completed project within its public portfolio (warspect.com/en/projects), case studies, and professional social profiles, unless a prior Non-Disclosure Agreement (NDA) explicitly forbids it.

7.5 Warspect trademarks

The Warspect trademark, logotype, visual identity, website copywriting, and design assets are the exclusive property of Warspect and protected under Peruvian and international intellectual property laws.

8. Limitation of liability

Warspect designs and codes adhering to high modern standards. However, Warspect cannot be held liable for:

  • Downtime, network outages, or payment processor interruptions caused by external hosting vendors, cloud platforms, or third-party APIs.
  • Indirect damages, lost profits, or business interruption arising from the operation or temporary unavailability of the client's website.
  • Security breaches resulting from compromised client credentials, weak passwords, or post-delivery modifications by unauthorized parties.
  • Future incompatibilities triggered by third-party browser breaking changes or external API deprecations.

Under all circumstances, Warspect's maximum aggregate financial liability toward the client for any claim arising under the engagement shall be strictly capped at the total amount actually paid by the client for the specific project in dispute.

9. Acceptable website use

Users interacting with warspect.com agree to act lawfully and ethically, refraining from:

  • Submitting unsolicited commercial communications, spam, or malicious payloads through the contact form.
  • Executing unauthorized automated vulnerability scans, scrapers, or denial-of-service attempts.
  • Impersonating any person or entity, or submitting deceptive project inquiries.

10. Policy updates

Warspect reserves the right to amend these Terms and Conditions at any time to align with legal developments, regulatory updates from INDECOPI, or evolutions in service models. Amendments become binding upon publication on this page.

11. Governing law and jurisdiction

These Terms and Conditions and any contractual engagement between Warspect and its clients are governed by and construed in accordance with the laws of the Republic of Peru.

Any dispute, controversy, or claim arising out of or relating to these terms shall be submitted to the exclusive jurisdiction of the Courts of the Judicial District of Lima, Peru, with express waiver of any other forum, without prejudice to consumer protection rights enforceable before INDECOPI under Peruvian Law.
